We may update this Privacy Policy from time to time as we update or expand our Live365 Service. If we make material changes, we will post the updated Policy on this page with a “Last Updated” effective date of the revisions. Information We Collect About You and How We Collect It
Live365 collects personal data when you interact with our Live365 Service. Personal data is any information that identifies or makes an individual identifiable. The definition of personal data (used interchangeably in this Privacy Policy with the term “personal information”) depends on the applicable law based on your physical location. Only the definition that applies to your physical location will apply to you under this Policy.
The types of personal information that we may collect about you include, but are not limited to: information you provide to us, information collected automatically about your use of our Live365 Service, and information from third parties.
We use anonymized and aggregated information for purposes that include testing our IT systems, research, data analysis, creating marketing and promotion models, improving the Live365 Service, and developing new features and functionality within the Live365 Service.
- Information You Voluntarily Provide Us: The personal data we collect on or through our Live365 Service may include the following information:

Please note: When communicating with us by email or through forms on the Live365 Service, we ask that you please do not send us any sensitive information pertaining to yourself or others. Live365 does not collect or store sensitive information or special categories of personal data.
- Information from Third Parties: When you interact with our Live365 Service or
accounts on a social media platform, we may collect the personal information that you or the platform make available to us on that page or account, including your social media account ID and/or user name associated with that social media service, your profile picture, email address, friends list or information about the people and groups you are connected to and how you interact with them, and any information you have made public in connection with that social media service.
The information we obtain depends on your privacy settings on the applicable social media service; we will comply with the privacy policies of the social media platform and we will only collect and store such personal information that we are permitted to collect by those social media platforms. When you access our Live365 Service through social media channels or when you connect our services to social media services, you are authorizing us to collect, store, and use such information and content in accordance with this Policy.
- Information Collected Automatically: As you navigate through and interact
with our Site or Apps, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:
- Information About Your Use of the Services: when you browse our Site, our systems automatically collect information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, domain names, referring and exit pages and URLs, platform type, pages viewed and the order of these page views, the amount of time spent on particular pages, and the date and time of your request.
- Device Information: if you access the Services through a mobile device (e.g., a smart phone or tablet), we may be able to identify the general location of your mobile device, your mobile device’s brand, model, operating system, resolution, screen size, system version, mobile network information, and your mobile device’s advertising ID.
- Performance Data: information about your preferences to make your use of the Live365 Service more productive, via the use of cookies or similar tracking technologies.
How We Use Your Information
Live365 will only use your personal data as described in this Privacy Policy or as disclosed to you prior to such processing taking place. The purposes for which we may use your personal information include:
- To Provide You Our Services: using personal data for internal and service-related
purposes, including to operate, provide and maintain the Live365 Service, as well as for accumulating and reporting aggregate, statistical information in connection with the Site, Apps, and user activity, including determining which features and services users like best to help us operate, enhance, and improve our services;
- To Provide You with Service-Related Communications: contacting you regarding
the administration of any features or functions of the Site or Apps you have registered to use, and notifying you about changes to our Live365 Service, our policies, terms, or any products or services we offer or provide, as well as providing you with notices about your account and responding to your questions or other requests;
- To Send You Marketing and Promotional Emails: contacting you with newsletters,
marketing or promotional materials and other information that may be of interest to you based on the features or services that you already use or the offerings that you have already subscribed to or inquired about, unless you have opted not to receive such information;
- To Enforce Compliance with Our Agreements or Policies: keeping you secure and
safe while using our Live365 Service, which requires us to process your personal data in accordance with this Policy to combat spam, malware, malicious activities, fraud, or security risks as part of our ongoing maintenance and enforcement of our security measures, and carrying out our obligations and enforcing our rights arising from any contracts entered into between you and us, including our Terms or for billing and collection;
- To Maintain Legal and Regulatory Compliance: processing personal data to pay our
taxes, fulfill our business obligations, for compliance with employment and recruitment laws, or as necessary to manage risk under applicable law;
- For Customization: saving your user account, registration and profile data or other
personal data; tracking your return visits to and use of the services; tailoring your experience on the Site or Apps; and/or otherwise customizing what you see when you visit and use the Live365 Service;
- For Research Purposes: for research purposes and to provide anonymous reporting
for internal and external clients and business partners;
- With Your Consent: for any other purpose disclosed to you prior to you providing us
your personal data or which is reasonably necessary to provide the Live365 Service or other related products and/or services requested, with your permission or upon your direction;
- For Employment Purposes: processing job applications, including to communicate
with you and to conduct applicant and employment-related statistical evaluation and record-keeping.
- Sharing and Disclosure of Personal Data
We may share or disclose your personal data in the following circumstances:
- Within Our Corporate Organization. We may share your personal data with any
Subsidiaries and affiliates in order to provide you with the Live365 Service and take actions based on your request, as well as for the purpose of management and analysis.
- Service Providers. We may employ other companies and individuals to facilitate our
Live365 Service, provide services on our behalf, perform service-related business activities, or assist us in analyzing how our Site or Apps are used. These service providers provide us support services such as credit card processing, payment gateways, subscription processing, website hosting, customer relationship management, email and postal delivery, analytics, surveys, advertising and marketing services, and videoconferencing. The service providers have access to your personal data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
- Corporate Transactions. We may disclose personal data to a buyer or other
the Live365 Service’s users is among the assets transferred. You agree to and do hereby consent to our assignment or transfer of rights to your personal information, or else we ask you to please discontinue use immediately and contact us to delete your personal data.
- As Required by Law and to Protect Lawful Interests. We may disclose your
information if we believe that the disclosure is required by law, if we believe that the disclosure is necessary to enforce our agreements or policies, in response to valid requests by public authorities (e.g., a court or a government agency), or if we believe that the disclosure will help us protect the rights, property, or safety of Live365 or our customers.
- With Your Consent. We may disclose your personal data for any purpose with your consent.
Publicly available information
Information including your station name, website URL, station logo, station profile cover art, social media account links, genres, and station description (“Public Information”) will be available publicly and to be utilized by other Live365 users. This information is generally not considered to be personal data.
Non Affiliated Companies
We do not rent, sell, or share personal information about you with other people or non affiliated companies for their direct marketing purposes.
Social Networking & Other Websites
Live365 may allow you or other users to share Public Information you submit to the Live365 Service with social networking and other sites, such as your station’s name with “now playing” information. We do not share your personal data with other websites unless you direct the Live365 Service to do so.
Search Engines
Your Public Information submitted to the Live365 Service will be available to search engines, such as Google or Bing, just like any normal social media service.
Cookies and Similar Technologies
For more detailed information about the cookies and similar technologies used on the Live365 Service, as well as our website “Cookie Settings” tool that allows you to adjust your cookie preferences on our Site, please see our Cookie Policy available at https://live365.com/legal/cookies.
- Cookies. We may use cookies, embedded scripts, software development kits (“SDKs”)
and other similar technologies to collect additional personal data automatically as you interact with the Live365 Service and to personalize your experience with our service. We also may use these technologies to collect information about your online activities over time and across third party websites or other online services.
Cookies are small web files that a site or its provider transfers to your device’s hard drive through your web browser that enables the site’s or provider’s system to recognize your browser and remember certain information. We use first-party and third-party cookies for the following purposes:
- to make our Live365 Service function properly and to improve our services;
- to make login to our services easier (such as by remembering your user ID);
- to track your interaction with the services;
- to collect information about your activities over time and across third party websites or other online services in order to deliver content and advertising tailored to your interests; and
- to provide a secure browsing experience during your use of our services.
We may place cookies from third-party service providers who may use information about your visits to other websites to target advertisements for services available from us. We do not control the types of information collected and stored by these third-party cookies. You should check the third-party’s website for more information on how they use cookies.
- Your Choices. Your browser may provide you with the option to refuse some or all
browser cookies. You may also be able to remove cookies from your browser. You may also update your cookie preferences in relation to our website by clicking the “Cookie Settings” button found within our Cookie Policy here. - First-Party Cookies. You can use the browser with which you are viewing our Site to enable, disable or delete cookies. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. In addition, most web browsers provide help pages relating to setting cookie preferences.
Data Retention and Deletion
We keep your personal data only as long as necessary to provide you with the Live365 Service and for legitimate and essential business purposes, such as maintaining the performance of the Live365 Service, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes.
We keep some of your personal data for as long as you are a user of the Live365 Service. For example, we keep your playlists, station information, media library, and account information.
As described further below, if you request, we will delete or anonymize your personal data so that it no longer identifies you, unless we are legally allowed or required to maintain certain personal data, including situations such as the following:
- If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved;
- Where we are required to retain the personal data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or,
- Where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.
Communications Preferences
In order to provide service to you, we may send you communications related to your transactions, security, or the administration of the Live365 Service. From time to time, we may also send you other messages or updates about Live365, our Site or Apps, and our other products and offerings. If you do not wish to receive non-transaction or security-related communications from us, you may opt-out by clicking the “unsubscribe” link in the communication or by contacting us as specified in the “How To Contact Us” section below.
You may also update information about your account with us. We will update and correct your profile if you wish to make changes. Please note that if you opt out of receiving communications from us, we may still send you service communications such as emails about your account.
Please note that “opt-out” and “unsubscribe” requests may not take effect immediately and may take a reasonable amount of time to receive, process and apply, during which time your information shall remain subject to the prior privacy settings.
By downloading and using our mobile applications, you may receive messages, reminders, offers, news, and information from Live365 within the mobile application itself. These “in app” messages are part of our mobile application’s functionality but can be adjusted using your device or app settings.
Access, Correction and Deletion of Your Personal Data
You have the right to access, correct, and delete your personal data that you shared with us on our Site or App or through other means. We are committed so that your personal data is kept accurate and up to date. However, it is up to you to update it with any changes. In most cases, you can review and submit changes to your personal data by logging into your account profile page within the Live365 Service. You may also notify us via the information in the “How To Contact Us” section below to request access to, or to correct any personal information that you have provided to us. We may not accommodate a request to delete or change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you no longer wish to have your personal information processed, you may request to delete your account, subject to certain limitations, by contacting us as described below.
Notice to California Residents
This section applies solely to individuals who reside in the State of California. Although the California Consumer Privacy Act (“CCPA”) does not currently apply to Live365, we nonetheless wish to voluntarily extend some of the CCPA’s rights to California residents. The purpose of this section is to inform California residents (“consumers” or “you”), at or before the time of collection of personal information, about our data collection practices and the privacy-related privileges we choose to extend in our discretion. We honor the CCPA’s “right to know” about personal information collected, used, and disclosed by Live365, which includes what categories of personal information we collect from you and the purpose for its collection; how we use those categories of personal information; and how we share the personal information you entrust to us.

Sale of Personal Information Under the CCPA — We may sell your personal information to third parties, although not in the traditional sense of the word “sell,” but in the CCPA’s definition of that word, which can include making available personal information or identifiers linked to you for a benefit. You may, at any time, direct us not to sell your personal information. To opt out, email us at Legal@Live365.com. For us to identify you in our system, please provide the email address associated with your Live365 account, along with the main contact name that the billing account is under.
If you submit a request to opt-out of sale and we are unable to locate a current or former account using the information provided in your request, we will record your preference and comply with your request to the extent we are able to identify you.
We will act upon opt-out requests within 15 days of receipt and will notify you and/or your authorized agent when the request has been processed.
Rights Under the CCPA
Access to Specific Information and Data Portability Rights – Subject to certain exceptions, if you are a California resident you have the right to request a copy of the personal information that we collected about you during the 12 months before your request. Once we receive your request and verify your identity, we will disclose to you:
The categories of personal information we have collected about you;
The categories of sources for the personal information we have collected about you;
Our business or commercial purpose for the information collection;
The categories of third parties with whom we share that personal information; and
The specific pieces of personal information we collected about you.
Deletion Request Rights – You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.
Opting Out – As described in the “Sale of Personal Information Under the CCPA” section above, California residents have the right to opt-out of having their personal information sold.
Non-Discrimination –We recognize and respect that you have the right to not receive discriminatory treatment by the business for exercising any of your CCPA rights.
Exercising Access, Data Portability, and Deletion Rights –To exercise the access, data portability, and deletion rights described above as a California resident, please submit a verifiable consumer request to us by contacting us as described in the “Contact Us” section below.
Use of an Authorized Agent to Submit a Request – Only you or a person you formally authorize to act on your behalf, may make a verifiable consumer request related to your personal information as a California consumer. If you use an authorized agent to submit such a request, we will require written proof that the authorized agent has been authorized to act on your behalf or a copy of the power-of-attorney document granting that right.
Direct Marketing — If you are a California resident, you can request a notice disclosing the categories of personal information we have shared with third parties for the third parties’ direct marketing purposes. To request a notice, please submit your request by postal mail to the contact information listed below.
Important Notice for Non-U.S. Residents
The Live365 Service and its servers are operated in the United States. Please be aware that your information, including your personal data, may be transferred to, processed, maintained, and used on computers, servers, and systems located where the privacy laws may differ from those in the jurisdiction where you reside. If you choose to use our Site or Apps while located outside the United States, such as in the EEA, the United Kingdom, Switzerland, or elsewhere, you hereby irrevocably and unconditionally consent to such transfer, processing, and use of your information in the United States and elsewhere. If you do not wish for your information to be transferred to, processed, or maintained outside of the country or jurisdiction where you are a resident, you should immediately cease accessing our Site or Apps.
Additional Disclosures for Data Subjects in the EEA, the U.K. and Switzerland
This section provides general information about how Live365 collects, stores, uses, transfers and otherwise processes personal data in or from certain countries in the European Economic Area, the United Kingdom, and Switzerland (together, for purposes of this section of the Privacy Policy, “EEA”), in accordance with the General Data Protection Regulation (“GDPR”) and its local implementations.
Lawful Bases of Processing – Where Live365 is acting as a data controller that determines the purposes and means of processing your personal data, such as when we collect, use, and share personal data as described in Sections 2 through 4 above, we must have a lawful processing basis for doing so. Our lawful bases for processing personal data include:
- to conclude or perform a contract with you, for example to:
- process your subscription to sign up as a broadcaster;
- complete your registration as a user or to communicate with you about your account;
- for our legitimate business purposes, including to:
- respond to your customer service inquiries and requests for information;
- maintain, improve, and analyze our Site, Apps, advertisements, and the products and services we offer;
- detect, prevent, or investigate security breaches or fraud; and
- facilitate the functionality of the Live365 Service;
- to comply with our legal obligations, for example to maintain appropriate records for internal administrative purposes and as required by applicable law; and
- on the basis of your consent, for example to send you via email and other electronic means personalized promotions and special offers or informing you about our professional services, offerings, events, or other promotional purposes.
You can withdraw your consent at any time by contacting us as described in the “How To Contact Us” section below.
Your EEA Data Subject Rights – Under certain circumstances, by law you have the right to:
- Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you.
- Request correction of the personal data that we hold about you.
- Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it.
- Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party), or where we are processing your personal information for direct marketing purposes.
- Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you.
- Request the transfer of your personal information to another party, when possible.
- Not be subject to automated decision-making producing legal or significant effects on an individual, which we do not engage in.
To exercise any of these rights, please contact us as set forth in the “How To Contact Us” section below and specify which GDPR privacy right(s) you wish to exercise. We must verify your identity in order to honor your request, which we will respond to within 30 days of receipt.
Transfers – When we transfer or receive personal data from the EEA, we do so pursuant to appropriate safeguards or your explicit consent under GDPR Article 49.
Retention – As described in the “Data Retention and Deletion” section above, as a general rule, we keep your data for only as long as it is needed to complete the purpose for which it was collected or as required by law. We may need to keep your data for longer than our specified retention periods to honor your requests, including to continue keeping you opted out of marketing emails, or to comply with legal, regulatory, accounting or other obligations.
Complaints – If you have any issues with our compliance, you have the right to lodge a complaint with an EEA supervisory authority (link). We would, however, appreciate the opportunity to first address your concerns and would welcome you directing an inquiry first to us per the “How To Contact Us” section below.
Links and Integration of Third-Party Platforms and Services
We may display advertisements from third parties and other content that links to third-party websites. We cannot control or be held responsible for third parties’ privacy practices and content. If you click on a third-party advertisement or link, please understand that you are leaving the Live365 Service and any personal data you provide will not be covered by this Policy. Please read their privacy policies to find out how they collect and process your personal data.
Keeping Your Personal Data Safe
We are committed to protecting our users’ personal data. We implement appropriate technical and organizational measures to help protect the security of your personal data. We have implemented various policies including pseudonymization, encryption, access, and retention policies to guard against unauthorized access and unnecessary retention of personal data in our systems.
The safety and security of your information also depends on you.
